LFVP Limited, (herein referred to as, “LuvFans.VIP,” “we,” “us,” “company,” or “our”) are committed to safeguarding your privacy, recognise and respect the importance of keeping our users personal data safe on our website. The terms including but not limited to; “visitor,” “visitors,”“user,” “users,” “fan”, “fans”, “creator,” “you,” “your,” and “creators,” shall refer to all users. The terms including but not limited to; “third party,” “third parties,” refers to contractors, advertisers, content providers, promoters, institutions or service providers.

By visiting, or using our website or services, you consent and agree with our “Terms and Conditions” and other policies. If you do not agree with our Terms and Conditions or any of our other policies, you must leave and not use our website. You warrant and represent to LuvFans.VIP that you are least 18 years of age, as minors (persons under the age of eighteen) are forbidden from accessing or using our website.

You must ensure that the content that you are viewing or uploading is legal in your country of residence and is compliant with our terms and policies, by using our website, you agree and accept that we do not hold any responsibility or liability if you do not do this and the liability solely rests with you.

Access and registration to LuvFans.VIP is free.

If you breach any part of our Terms and Conditions or policies, we may revoke, block or suspend your access and/or cancel your account.

By using LuvFans.VIP, you consent to our use of cookies in accordance with our terms and our privacy policy.

LuvFans.VIP respects the rights of all users of our website; including but not limited to all users, creators and third parties. LuvFans.VIP functions as an online platform which distributes your uploaded content onto our website to the public. By uploading your content to LuvFans.VIP you agree and acknowledge our usage of the content which includes, but is not limited to; advertising, publishing, marketing and promoting this content on behalf of yourself or LuvFans.VIP. This agreement does not infringe upon your rights of copyright or other rights for any content uploaded and owned by you on LuvFans.VIP.

All software used to operate or display LuvFans.VIP is the property of LuvFans.VIP or is licensed to us. All website content (other than content owned by or licensed to our users or creators), including but limited to; graphics, content, data, functionality, software, code, and features available on our site are the exclusive property of LuvFans.VIP and/or our licensors. It is forbidden to use any content accessed from our website for commercial purposes without obtaining a licence to do so from LuvFans.VIP or our licensors.

For the purpose of our policy ‘content’ is defined as any works, publications, text, graphics, information, images, photos, videos, data, illustrations, whether purchased or not, in any format, submitted by us, our creators or obtained by accessing our website.

If you do not have a licence to use content, have express written consent or have legal rights to use any content you must not modify, transmit, copy, distribute, sell, publish, reproduce, transfer, publish, use to create derivative works, display, or otherwise exploit whether in whole or part any content associated with LuvFans.VIP, our creators or third parties.

If you have reason to believe your work has been copied onto the LuvFans.VIP in a way that constitutes copyright infringement, please email this information to help@luvfans.vip , please include:

a) A full description of the copyrighted work you claim has been infringed and a link to where it is located on LuvFans.VIP;

b) Your email address, telephone number and physical address so that we may contact you;

c) An electronic or physical signed statement of a person authorised to act on behalf of the copyright owner;

d) A statement as to why you believe the copyrighted content in question has not been authorised by the copyright owner;

e) A statement why you believe the above information provided by you is accurate, you are the copyright owner, and will be willing to confirm this under penalty of perjury.

LuvFans.VIP prohibits any content containing minors, children or young persons under the age of 18. If you see any content depicting minors engaged in sexual activity, child exploitation, child pornography (real, implied, live or animated) on our website please immediately report it to abuse@luvfans.vip. In your report please include any supporting evidence, dates, times, user names, website, links etc. LuvFans.VIP fully cooperates with any law enforcement, legal entities or agencies investigating abuse of minors, child exploitation and sexual abuse abuse of minors.

Any content you have uploaded to LuvFans.VIP will not be displayed on any other website other than LuvFans.VIP unless you have elected to allow your profiles content to be used for advertising, marketing or promotions externally by LuvFans.VIP.

User Content: Licence - giving us full right to use content

In these terms and conditions, LuvFans.VIP “user content” means all material and works uploaded by all users of this website (whether a creator, fan or general user) that other users can see. All users of LuvFans.VIP may customise their accounts by uploading any materials or works (including and not limited to images, photo’s, all text, bio text, audio material, video materials, all data, scripts, comments, hashtags, interactive features, emojis, GIFs, memes, software, files and any other material) to the website granting LuvFans.VIP licence to process, store, transmit and publicise all “users content” submitted via/to LuvFans.VIP.

You confirm that you own all rights necessary, rights of your content or that you have obtained all licensing rights to your content which are required to grant the foregoing licence to LuvFans.VIP and to other users or third parties granted by LuvFans.VIP in accordance with these Terms and Conditions. You confirm that use of all content, information or data in accordance to these Terms and Conditions do not violate applicable laws or third party rights, including laws concerning privacy, publicity, third-party rights, with respect thereto.

You agree to grant us a worldwide licence under all of your content in any territory in which LuvFans.VIP can be accessed, and to perform any act restricted by any right for any purpose reasonably related to the provision and operation of LuvFans.VIP (for all “user content”), non-exclusive, irrevocable, royalty-free, perpetual, sub-licensable, transferable, assignable right, allowing LuvFans.VIP to reproduce, distribute, publicly display, publish and create adaptations or derivative content as necessary. This means that the licence granted will be continuous even when your user account is closed or your agreement with LuvFans.VIP ends, that we do not have to pay you for the licence, and that in some cases we may we grant a sublicense of your content to someone else or assign or transfer the licence to someone else. You also grant in agreement to the licence to allow us (but not limited to) to add watermarks, stickers or logos to your content. LuvFans.VIP may sell or transfer any licence you grant to us in these Terms and Conditions in the event of a sale of our company or its assets to a third party. We will never sell your Content to other platforms.

Whilst LuvFans.VIP does not own your content, you grant us the right to submit or withdraw an action of infringement for the licensing rights above where we consider it appropriate to do so on your behalf or in the interest of LuvFans.VIP. However LuvFans.VIP are not responsible and are under no obligation to police any infringements of your content, you agree that if at any point we request, you can and/or will provide us with evidence of consents and other information which we may need to submit notifications of infringement on your behalf or in the interest of LuvFans.VIP.

Without prejudice to our other rights under these terms and conditions, if LuvFans.VIP reasonably suspect in any way that you have breached these terms and conditions, or if you breach any provision of these terms and conditions we may unpublish, edit, void or delete any or all of your content under these terms and conditions.

Prohibited Use : Rules

By using LuvFans.VIP you agree and represent that your content, material, work and use of LuvFans.VIP complies with our Terms and Conditions. This includes but is not limited to posts, picture titles, video titles, descriptions, names or messages.

All users of LuvFans.VIP:

a). Must not supply or depict any content, upload text, images or audio that contains any person under the age of 18 years old (or which generally refers to individuals under 18 years old)

b). Must not use LuvFans.VIP in any way which may harm, attempt to harm, exploit or attempt to exploit any persons under 18 years old, suggest any under age activity or expose persons to any inappropriate content or behaviour whether published or posted in the context of role-play or otherwise. This includes but is not limited to picture titles, video descriptions, messages, profiles, usernames or any posts.

c) Must not include any other individual unless you have documentation which confirms that individuals shown or included in your content are at least 18 years old and that you have written consent from each individual to use their name, images, audio or any content which includes them.

d). Must not post, upload, share, display, publish, use any content (audible, textual or graphical) that promotes, advertises, shows, refers to or suggests incest, sexual assault, harming of animals or act of a person appearing to perform sexual activity with an animal, violence, blood/bleeding, content depicting punctured or broken skin, cuts, insertion of sharp objects, hypnosis, intoxication, illegal depictions of hanging, extreme fisting, suffocation, dismemberment or genital/graphic mutilation, realistic portrayals of rape, content depicting heavy bruising, weapons, knives, firearms/imitation firearms (guns), goods or materials whose possession, use or sale is subject to prohibitions or restrictions. Sadomasochism, bondage (bondage, where no apparent means of withdrawing consent is available), urination, torture and certain activities involving “perversion” are allowed in England and Wales according to the CPS: (“So long as the material features consenting adults; no serious physical or psychological harm or injury is caused; no criminal acts are being displayed; and the likely audience is not under 18”);

e). Must not post, upload, share, display, promote, depict, constitute, publish, use any content (audible, textual or graphical) that promotes, advertises, shows, refers to or suggests paedophilia, bestiality, necrophilia, revenge porn (sharing of private, sexual content or material without their consent and with the purpose of causing embarrassment or distress being posted online or offline), extreme porn (as governed by the country in which you reside), self harm or suicide, scatological, excrement-related material, sex trafficking, unsolicited sexual content or language, fake or manipulated sexual content such as “deepfake”, partake in prostitution, escort services or meet ups.

f). Must not post, upload, share, display, publish, use any content (audible, textual or graphical) that promotes, advertises, shows, refers to or suggests religious or racial hate speech, terror, be blasphemous, discrimination, have intentions to exclude, threaten, vilify, dehumanize, humiliate, attack, incite hate, evoke fear, anxiety, annoyance, be morally offensive, inconvenience or violence towards a particular group, sex, age, gender identity or expression, disability, sexual orientation, ethnicity, race, nationality, immigration status, or any other status.

g). Must not be threatening, harassing, offensive, abusive, hateful, menacing, deceptive, fraudulent, inflammatory or discriminatory;

h). Must not be misleading, false, untrue, deceitful or inaccurate;

i). Must not post or communicate any activities normally conducted against ones will, consist of any advice, instructions or information that if acted upon could cause injury, illness, loss, damage, loss of life, acts that threaten or appears to threaten life or physical harm, constitute an incitement to commit crime, criminal activity, acts of self-harm or appears to be self-harming, promote or instruct crime;

j). Must not be in breach of any contractual obligation owed to any persons that would affect your use of our services, be illegal, infringe on any copyright, trademark right, confidentiality rights, licensing rights, moral rights, lawful rights, legal rights, privacy rights or data protection rights;

k). Must not post, converge, depict drugs or drug paraphernalia, ‘legal highs’, ‘poppers’ (amyl nitrate) or any other substance misuse. Content that depicts sexual acts or activities being performed whilst clearly intoxicated are not permitted.

l). Must not use LuvFans.VIP to bully, threaten, stalk, harass, isolate or intimidate anyone else.

m). Must not post or communicate any content which constitutes spam, engage with activities that could affect our systems, services, security, content or communications which is repetitive, misleading, inauthentic or of a low quality;

n). Must not modify, reproduce, distribute, transmit, print, download, create derivative works of, store, publicly display or republish any content on LuvFans.VIP, except as permitted under our Terms and Conditions.

o). Must not share or communicate any information that contains or refers to theirs or anyone else’s personal, confidential or private data e.g. phone numbers, addresses, GPS coordinates, email addresses, bank account or credit card details, medical records, car number plate, identification documents;

p). Must not produce content that gives the impression that is has been endorsed, approved or licensed by us without our expressed consent, use our name, trading name, similar names, logo, media, designs or slogans other than in ways which are expressly permitted by us, have been given our consent or with prior written agreement;

q) Must not blackmail, extract money or any other benefit from anyone else in exchange for the removal of content or to uphold their privacy;

r). Must not cause inconvenience, be likely to upset, cause serious offence, constitute any negligent statements or advice, embarrass, be maliciously false or libellous;

s). Must not promote third party services, products, promotions, business activities, marketing, job posting or employment ads without LuvFans.VIP’s authorisation or express written consent;

t). Must not register with usernames or use nicknames that imply or suggest illegal activities, use codewords, media or any methods to communicate anything that violates our Terms and Conditions;

u). Must not impersonate, attempt to falsely represent or mislead LuvFans.VIP, our employees or any other person or company, falsely suggest or state any affiliation, sponsorship, endorsement or partnership between you and us or any other company or person in conjunction with LuvFans.VIP.

v). You must not use false account information, registration details, identification or use anyone else’s data or content;

w). It is forbidden to add content with an advertisers watermark, copyright or reference to a legal entity such as a person or company unless you have been given approval by LuvFans.VIP.

You warrant that LuvFans.VIP will not be held liable if you break any of these rules. Breaches of our Terms and Conditions may result in termination or suspension of your account and access to your earnings being revoked.

3) If a merchant allows a third-party user (“content provider”) to upload or generate content, including real-time/live streaming, the merchant must enter into a written agreement with each content provider, and the merchant must submit a copy of this type of document during the review process. This copy refers to a draft version of what the content providers or models have/will sign, the merchant need not provide each agreement that the content providers/models have entered into.

The content agreement must:

*Prohibit any activity that is illegal or otherwise violates the Standards

*Require the content provider to obtain and keep on record written consent from all persons depicted in the content specific to the following areas:

• Consent to be depicted in the content

• Consent to allow for the public distribution of the content and to upload the content to the Merchant’s website

• If the content will be made available for downloading by other users, consent to have the content downloaded

*Require the content provider to verify the identity and age of all persons depicted in content to ensure that all persons depicted are adults and to be able to provide supporting documents upon request.

Businesses and organisations

Individuals, businesses, legal entities who represent companies or act on behalf of the company and organisations who use, engage or utilise services on our website will be bound by our terms and conditions.

Businesses and organisations will only be paid monies to a bank account in their company’s name. No third party payments will be processed.

Registration, Accounts Security and Commitment to us

You may register for an with LuvFans.VIP by completing our registration account form. You will need to verify your account with us before you are able to access your LuvFans.VIP account.

(a). You must be over 18 years old and agree to provide accurate, current and complete information about you. (b). You agree to maintain the security of your user details, password and any other information you provide to LuvFans.VIP.

(d). You confirm that you are fully responsible for all use and activities of your account and for any actions that may take place.

(e). If you have previously had an account with us, you confirm that your old account has never been made void, suspended or terminated by us because of violation of our terms and conditions.

(f). You agree to update your information on LuvFans.VIP should it change in a timely manner. You confirm that you are responsible for any failure to keep your account details and password confidential and acknowledge that you may be held liable for any losses that may arise from such failure.

(g). You agree to keep your account/login details confidential.

(h). You agree to inform LuvFans.VIP if you believe your account has been subject to any breach of security or if someone has used or is using your account without your permission.

(i). You agree to log out of your LuvFans.VIP account at the end of each session and take precautions so that others are not able to view, record or access your account/login details.

(J). You consent to receiving digital/electronic communications from LuvFans.VIP such as emails, notifications, messages and to the processing of your personal data.

k). You agree not to use any other person’s account to access LuvFans.VIP unless you have that person’s express permission to do so.

(l). You agree to abide by the laws of your state/country or province in regards to using/accessing LuvFans.VIP.

m). You commit to ensuring you have expressed written consent from any other persons shown within your content. You expressly agree without exception that all participants are over the age of 18 and any liability rests solely with yourself for the misuse of other people's content. Evidence may be requested at any time and subsequent failure to provide requested consent forms may result in your account being closed immediately without notice or remuneration. Persons who have given consent previously may withdraw this consent anytime in writing.

n). LuvFans.VIP asks for identification to verify your identity. Uploading images that are irrelevant to the identification documentation requested will be seen as a deliberate attempt to avoid verification and will mean that your account will not be approved. The primary form of photo identification which we accept is a signed passport. If you do not have a passport, we can accept other forms of photo identification which will be advised to you.

Non-UK nationals may be required to submit additional identification and verification before having their profile approved. This may include submitting two forms of identification and proof of residence in your country.

We endeavour to approve profile verifications once the appropriate form of identification has been submitted within 24-48 hours.

We may ask for additional identity or age verification at any time. In the event that the authenticity of a profile is deemed questionable or possible fake or falsified identification, we may suspend or immediately terminate the account in question and reject further attempts to create an account with us.

LuvFans.VIP makes no guarantee or warranty that verifications submitted by users are related to the persons indicated.

Creator accounts may be rejected for any reason including the reasons stated here.

LuvFans.VIP reserves the right to terminate your access to our website at any time for any violation of these Terms and Conditions.

Termination and suspension of account

We reserve the right to review (but not obligated to) and/or monitor any of your content to verify compliance with these Terms and Conditions and/or any applicable law and to

a). terminate, limit, suspend and/or deny you access to your account on our website at any time at our sole discretion.

b). Any user's earnings which otherwise have fallen during the period of suspension will be suspended during the period of suspension and we may withhold part or all of a creator's earnings in accordance with our terms and conditions.

c). Delete non-compliant user content at our sole discretion without notice to you at any time.

d). You will be notified by email or digital/electronic message if we terminate, suspend or limit access to your account.

e). You may request a review of our decision to terminate or suspend access to your account by contacting us.

f). If we reinstate or permanently remove or disable access after investigation of non-compliance or unlawfulness you agree at your own cost to provide reasonable assistance in our investigation and provide us with any information we may request.

We also have rights to suspend or cancel your account if a). If you take any action in our opinion that has caused or is likely to cause LuvFans.VIP a loss, harm our reputation or if you attempt to threaten any part of our terms and conditions that could lead to serious consequences for another user or us. b). If we decide to terminate your account all content and data may be deleted and you will no longer be entitled to access your content

c). LuvFans.VIP will cooperate with law enforcement agencies on any suspected or alleged misuse, unlawful, abuse or illegal activity and can disclose any data or records about your use of LuvFans.VIP in response to a court order.

How to set up your account to become a creator

To set up your account to become a creator you need to:

Click on ‘sign up’ at the top right hand corner of the home page, then enter your username, email address and password details. Once you have added all of these details click on ‘sign up’ underneath.
Then click on ‘verify profile’ and follow the instructions. You must do this in order to take payments.
Fill in your personal details and attach a photo of your ID with all four corners visible, attach a second clear photo of you holding your ID with your face clearly visible holding plain paper with your username fully visible and the date. We do not accept photos of you with your ID if the photos are not clear and the required information is not readable. ID’s out of date will not be accepted.
If you are advertised as a duo (two people providing content together) you must fill out the creators form and send in your required identification at the same time, if you decide to do it at different times you must open a new account.
Third party content must have the creators ID’s in a selfie, all individuals in the content selfie’s with matching ID, a creator's signed release form and the creator's selfie with the signed release form. This applies to third party applicants only (content where you are not the only participant or you are not advertised as a duo) not individual creators;
Once you have filled in all the relevant details click on ‘send for approval’. Our admin team aims to verify profiles within 48 hours.
Once you are verified and you wish to charge users to access your content, you will need to add your bank account details or the bank account of a corporate entity in which you are a Person with Majority Control and set up your monthly subscription fee you require users to pay.
Users will then be able to make payments for your subscription or chargeable content.

We may ask for additional information at any time. We may reject your application to create a creators account for any reason. You may need to submit extra information depending on which country you reside.

Agencies or agents associated with you cannot create a creators account on your behalf. Creators must have access to their accounts at all times. If you have an agency, agent, entity or an individual assisting you with the operation of your creator account, you warrant that you are the legal owner of your account and that this does not affect your personal legal responsibility to LuvFans.VIP. Our relationship is with you, and not your agency, agent, entity or individual operating your creators account on your behalf and you warrant that you are legally responsible for ensuring that all content, posts and all use of your account complies with our terms and conditions.

Locked and unlocked posts

Locked posts are available to paying monthly membership subscribers or users who tip to view the post. Locked posts are accessible for the duration of your subscription period, therefore, access is removed when your monthly subscription expires.

Unlocked posts are accessible to all free subscribers in their feeds and the public checking out a creator's profile.

Locked messages

Locked messages are accessible to fans who pay to view the locked message. The locked message amount is set by creators.

Payouts

Earnings are held on the creator's behalf in LuvFans.VIP’s capacity as the creators agent. Any money earned from subscriptions, unlocks and tips will be added to your total earnings amount. A 20% fee is deducted from total earnings made before earnings are paid to the creator. The creator earns 80% of total monies made. The payment you receive as a creator is your payout. LuvFans.VIP uses third parties to fulfil payments to our creators.

You have to request a payout by filling out our ‘Create Withdrawal Request’ form in your account. You must have the minimum earnings amount in order to make a withdrawal from your creator's account. The minimum earnings amount is $100. Payments using International Transfer (SWIFT) have a minimum earnings amount of $130.

We aim to pay our creators within 7 working days of requesting a withdrawal. Creator earnings are paid into your bank account or the bank account of an entity in which you are a Person with Majority Control.

If your bank account is eligible then the required IBAN and BIC numbers will be printed on your bank statement. Your bank may charge currency conversion or transfer fees for you to receive your earnings. All payments are transacted in USD only. LuvFans.VIP has no control over currency rates, transfer fees or any charges imposed by your bank, and we are not responsible for paying any charges imposed by your bank.

Payouts to entities

If you have created an account as an entity you must comply with all laws (including tax laws) that are applicable in the place where you are established and agree to provide evidence on request that you are the “Person with Majority Control” by meeting one or both of the following conditions: (A) the individual holds, directly or indirectly, more than 50% of the ownership interest in that entity; or (B) the individual holds, directly or indirectly, more than 50% of the voting rights in that entity;

If you are a creator using an entity to receive your earnings you agree to provide evidence on request that you are the “Person with Majority Control” and you warrant that you are complying with all laws (including tax laws) that are applicable to creators using entities in the place where the entity is established,and warrant that you are the legal owner of your account and that this does not affect your personal legal responsibility to LuvFans.VIP.

By using LuvFans.VIP you warrant and agree to comply with any tax rules that apply to you and have reported and will continue to report the receipt of all payments made to you in connection with your use of our website to the relevant tax authority in your jurisdiction, as required by law. By using LuvFans.VIP, you further warrant that you are solely responsible and liable for your tax affairs and for any non-payment of tax. We may close your creators account if we are notified or become aware of any tax non-compliance by you. We recommend all creators seek professional tax advice from their relevant tax authority or government body.

For the purpose of these terms and conditions “Tax” means all forms of tax and statutory, state, governmental, federal, provincial or municipal charges, duties, contributions, imposts, levies, withholdings, or liabilities wherever chargeable in any jurisdiction.

LuvFans.VIP reserves the right to ask for further identification or information as deemed necessary if required by our payment processing providers in compliance with anti-money laundering and other regulations before releasing payment.

Whilst we endeavour to maintain our payment options (e.g. bank transfer, wire etc), we cannot be held responsible for the operation or availability of these systems and your ability to withdraw or use your funds once transferred to them. You agree to accept the risks associated with each processing method when you specify your desired method of transfer.

If a user successfully seeks a refund or chargeback from their credit card provider with respect to a purchase made on LuvFans.VIP, we will investigate and deduct the amount from the creator's earnings earned on the charged-back or refunded amount.

If we have to delete or close any accounts due to the actions of the creator, we reserve the right to reimburse any outstanding subscribers and deduct it from the creator's money owed.

If we cannot pay out a creator's earnings after 12 months due to inaccurate information being provided by the creator and we cannot contact the creator, the creator will automatically forfeit their earnings, and the creators earnings will become our property. Creators' earnings that are deemed to be unclaimed property may be turned over to the applicable government body.

If you wish to dispute our earning calculation, you must notify us in writing no later than 30 days after that disputed calculation. Failure to notify us within this time period will result in the creator’s waiver of any claims related to that disputed calculation.

If after making a withdrawal request there are concerns around authenticity or whether the our terms and conditions have been adhered to by a creator or entity such payouts may become void and any earnings accumulated may be forfeited entirely or until such time authenticity and adherence can be assured.In certain circumstances we may withhold earnings due to you but not yet paid out if: You have been found to breach any of our terms and conditions, policies or if you attempt to threaten our terms and conditions or policies in a way which could have serious consequences for us, another user (including but not limited to actual or possible financial loss);

We may withhold part or all of your earnings if we determine that part of your earnings withheld by us is related to any breaches of our terms and conditions, if we find it is unrelated then we may pay the creator the portion of earnings we determine is unrelated to any breaches of our terms and conditions or suspected unlawful. You agree and warrant that if we consider that there has been any (included but not limited to) breach(es) of our terms and conditions or unlawful activity caused by you or another user that has or may cause us or another user actual or possible loss, we may withhold all of your earnings due to you but not yet paid and we may set off such amounts against any losses suffered by LuvFans.VIP.

You agree that monies may be held by us for as long as necessary to investigate the actual, threatened, or suspected breach, whilst we investigate to determine an outcome (as applicable). If after investigation it has been determined that you have breached our terms and conditions and/or there has been unlawful activity, your monies will be withheld and we shall not have any responsibility to you if we withhold or forfeit any of your creator earnings where we have a right to do so under these terms and conditions. If once we have finished our investigation we determine that a creator's earnings are forfeited, LuvFans.VIP will use our best efforts to return any users payments which resulted in forfeited creator earnings to the relevant users who purchased from the creator at the time.

Deactivating your account

If you decide to deactivate your account, you may request a final transfer of your remaining balance upto 12 months after your account last being active. You may be required to confirm your identity in order for us to process your request.

Signing into your account

You can sign in using your email address and your password. If you lose access to your account you can reset your password using the email address you signed to set up the account. If you cannot recall the email address you used to set up your account we may require you to submit your identification information again and any additional evidence we may need to prove your identity.

How do I delete my account?

If you would like to delete your LuvFans.VIP account, you can do so by making a request via email to help@luvfans.vip from the email address registered on your account. Please allow up to 30 workings days for account deletion if you are a normal user. If you are a creator, your account will remain open until the last day of your fans paid subscription period, following which you will receive your final LuvFans.VIP payment and your account will be deleted. You will receive an email confirmation upon the successful deletion of your LuvFans.VIP account. Once your account has been deleted we may indefinitely delete all your data and you will no longer have access or be entitled to access your account.

Distant contract rights

If you enter into contract with LuvFans.VIP, offer to enter into contract with us, or contract with us as a consumer (acting as an individual outside of your business, craft, trade or profession) with LuvFans.VIP by purchasing any of our online services, you have up to 14 days from the day of purchase to cancel our services to you. You may withdraw an offer to enter into contract or cancel a contract entered with LuvFans.VIP at anytime within the 14 day period of which you entered into contract, submitted your offer to enter into contract or contract with us as a consumer. You do not have to give any reason to LuvFans.VIP for your withdrawal or cancellation.You agree that LuvFans.VIP may begin the provision of services before the expiry period of 14 days from the date of purchase of these services. If our services are fully performed I.e you access your LuvFans.VIP account after a subscription or purchase has been made, you will lose the right to cancel without charge.

Creator Profiles

Your creator profile is used as a way to describe who you are and what you do. Your potential fans will be able to see your profile and follow you on LuvFans.VIP. You can add things such as a title, description, images and bio.

Your images that you upload should represent you currently and accurately. You are allowed to add older images of yourself as long as they do not misrepresent you or deceive other users otherwise your profile will be in jeopardy of deactivation and forfeiture of credits accrued.

We rely on our content creators to be true and not misleading when adding descriptions or titles. Misleading descriptions, titles, profiles or content may result in being removed, rejected, profile suspension, deactivation, membership terminated and earnings potentially forfeited. Creators content and any communication or commitments must be compliant with our terms and conditions and the law applicable in the creator's location. Creators may advertise individually, as a couple or duo but their accounts must include the following:

Each account must reference the individual, couple or duo profiles.
It is forbidden to advertise more than one person on your profile unless you provide a link of the other creators profile in the links section (who must have a profile link from LuvFans.VIP) and your link is provided on their profile(s). This can be done in the "Creator Profile Links" section in the "Edit Profile Page". If you are just hiring a creator(s) or the creator doesn't have a profile on luvfans.vip you must fill out a Content Provider Release Form to be able to feature someone in your content.

You must not:

Copy another creator’s profile beyond standard wording that could be applicable to many; Use words such as “recommended”, “admin”, “administration team” or other wording that would give the impression that your profile was from LuvFans.VIP employees. This applies to profile titles, descriptions or any field linked to a creator. Include any personal contact details such as email addresses, phone numbers, physical addresses, URLs or links to other websites in your profile or any content displayed therein. Impersonate LuvFans.VIP or give the impression that your creator account is being promoted by LuvFans.VIP whilst promoting your content if this is not the case.

Creators Linking to other websites

Links may be approved by LuvFans.VIP for personal websites or sites promoting creators as long as they are not direct competition or a site where visitors can purchase content that may compete with LuvFans.VIP in any way.

Social Profile links

The social profile link section is there so you can add your social profile links to LuvFans.VIP, you are only allowed to add links to the framed social websites listed. Links within framed social websites listed, external websites on LuvFans.VIP or inclusions of advertisements do not constitute favour, recommend, have partnerships or endorsements of such websites or any organisations associated with sponsoring those websites in any capacity or the content, advertising, products, services, terms and conditions or other materials presented on or offline of such websites, but are for your convenience.

You hereby agree to hold LuvFans.VIP harmless from any and all damages, losses and liability that may result from the use of such links that may appear on the site or the site services. LuvFans.VIP reserves the right to terminate any links or linking programmes at any time.

User profiles

You acknowledge and warrant that LuvFans.VIP cannot be held responsible for the behaviour of users either on or off the website and understand that LuvFans.VIP cannot guarantee that any information provided by users is accurate, true, current, complete and not misleading. You warrant and agree to not hold LuvFans.VIP liable in respect to any loss, damages or grievances arising out of any users behaviour, content or information.

You agree to the publication of content and posts relating to you, by others on LuvFans.VIP and you acknowledge that such posts may be defamatory, critical or otherwise unlawful and warrant that you will not hold LuvFans.VIP liable in respect of any such posts, irrespective if we are aware, not aware or ought to be aware of such posts. User provisions

No users are permitted to use profile titles, add to their description or any field words such as “recommended”, “admin”, “administration team”or other wording that would give the impression that the profile was from LuvFans.VIP employees. Misleading descriptions, titles, profiles or content may result in being removed, rejected, profile suspension, deactivation or having your membership terminated.

Users are not permitted to redirect other users away from LuvFans.VIP to other sites to purchase items from wish lists or for any other purposes.

LuvFans.VIP may have websites, links, hyperlinks or directions owned and operated by third parties on our website. You acknowledge and warrant that LuvFans.VIP has no control over such websites, resources, terms of business or policies. You hereby agree to hold LuvFans.VIP harmless from any and all damages, losses, liability, directly or indirectly, that may result from the use of such third parties that may appear on the site or the site services. You further agree you will not hold LuvFans.VIP responsible or liable for any loss or damage in connection with use or reliance on any such third-party websites, resources, services, goods or products. If you would like to share a post you can do so by clicking on “Copy Post” in the top right corner of the post and paste the link to whichever method you would like to share it e.g. email, (sms) text message, social media, another website etc.

Report Abuse

Third party user (content provider) uploads

As a Content Provider you agree that any persons/third party depicted who have been involved in any uploads or generated content, enter into a written agreement with Luvfans.VIP. You must complete and sign a copy of our Content Provider Release Form when there is more than one persons depicted in content provided. This must be available uppon request. Content Permission

Person(s) who are depicted in content without given written permission can appeal to have such content removed should the outcome of an investigation determine that consent was not given or is void under applicable law. Should there be a disagreement regarding an appeal, Luvfans.VIP will allow such disagreement to be investigated and resolved by a neutral body.

Refund Policy

If you are not happy with purchased subscriptions/content, please inform us via our contact page here.

You agree that you will not make any unjustified requests for a refund from any content creator you have purchased content from, or unjustified chargeback requests of your debit or credit card in relation to any transaction made between and a creator. If LuvFans.VIP considers any chargebacks or refund requests have been made by you in bad faith, LuvFans.VIP holds the right to immediately delete or suspend your user account. LuvFans.VIP may only issue a refund when a creator's account has been removed before the subscription period ends or in the case where a large proportion of content has been deleted or if you have a substantial reason.

If after investigation a user successfully receives a chargeback or refund amount from their payment provider for a transaction made on LuvFans.VIP, the amount may be deducted from the purchased content creators account to the equal amount earned by the creator in relation to the chargeback or refunded amount.

User Content Terms

In addition to our policies you warrant and represent that all content displayed, uploaded, shared or published complies with our terms and conditions and agree to the following:

Subject to these terms and conditions users may post content on LuvFans.VIP such as images, photo’s, graphic’s, video, music, bio’s, comments, digital communication, identifying information and other forms of content which we permit;

Content posted on LuvFans.VIP is not confidential, by posting on our website you are allowing users to access, view and use your content for their personal use;

You understand and acknowledge that users may view, copy, download, store, re-print, save, indefeinetly reserve your content or further disseminate your content even when it is not legally permitted to do so without your consent and do not hold LuvFans.VIP responsible for this;

You warrant that you either own your content (and all rights associated with it), own all the rights necessary to licence your content to be on LuvFans.VIP (this includes third party material licences and releases necessary for you to use that third party property), adhere with laws and regulations as governed by the United Kingdom, hold written consents, own necessary rights in all countries where your fans are accessing your content and have a valid licence to offer, use, exploit that content and supply your content to our users;

You warrant and represent that you have all the rights to grant the necessary applicable licence and that neither LuvFans.VIP or our users use, in accordance with these terms and conditions, violates any third party rights, applicable laws or any laws concerning intellectual property, privacy or regulations from content you provide.

User content posted on LuvFans.VIP can be seen by the general public once posted. LuvFans.VIP is not required to install measures to prevent copying or dissemination by third parties and is not required to take legal action on your behalf against such third parties.

Your content is of satisfactory quality, correlates with the description, any advertising, statement or representation which you make of the nature of your content and all relevant circumstances;

You agree that you will be liable to LuvFans.VIP and indemnify us if any warranties you have agreed to are untrue or falsely represented. This means you will be responsible for any damage or loss (including loss of profit) LuvFans.VIP suffers as a result of any of the warranties being untrue;

You agree and warrant to act as custodian of records for the content that you upload to LuvFans.VIP;

LuvFans.VIP does not endorse and is not responsible for any aspect of content posted by you or any other users onto our site. We do not have any obligation to monitor any content and have no direct control over what your content may contain;

You warrant that any persons other than you or in addition to you shown in any content uploaded to your account has given his or her prior express consent to appear within the content and for it to be posted online;

You are solely responsible for obtaining the required consent or licences from any co-authors or co-owners of content created sufficient enough to permit such content to be made available on LuvFans.VIP;

You agree and warrant that LuvFans.VIP will only pay out creators earnings to the account to which the co-owner or co-author content is uploaded. The account holder is solely responsible for dividing, sharing or distributing any revenue generated from the co-owned or co-authored content. Any such revenue-sharing shall be private, independent and an agreement between the parties involved, as LuvFans.VIP is not responsible for enforcing or providing any such agreements.

You agree and warrant to release LuvFans.VIP from and not to make any claims, disputes, entitlements or renumeration disagreements against us, from any disputes, claims, entitlements or renumeration disagreements arising from co-owned or co-authored content. You agree that all claims shall be independent of LuvFans.VIP and made against the creator who posted or appeared in the co-owned or co-authored content (as applicable).

You agree to only post co-owned or co-authored content in which you have obtained the required licence to post on LuvFans.VIP or express permission.

If you post co-owned or co-authored content on your account, we may require you to provide complete valid legal information for all individuals which appear in the content. If you fail to comply with our request we may delete the co-owned or co-authored content, restrict your permissions to post on our website, terminate your account, and/or withhold any portion of creator earnings earned on LuvFans.VIP but not yet paid out to you.

You are required but not limited to; Verify the identity of and age of all person(s) depicted in content to ensure that all persons depicted are adults over 18 years of age and to provide supporting documents upon request, provide written consent by the person(s) depicted in the content, consent to allow for the public distrinbuton of the content and to upload the content onto www.luvfans.vip, consent to have the content downloaded and distributed.

(o) The creator complies with 18 U.S.C. §§ 2257–2257A and 28 C.F.R. Part 75 and holds a copy of all required documents in conjunction in hard copy and written documentation. These documentations must be sufficient to confirm all participants were at least 18 years old at the time of production and will provide Luvfans.VIP with copies of all required written documents on request.

User Content: Licence - giving us full right to use content

You agree to grant us a worldwide license under all of your content in any territory in which LuvFans.VIP can be accessed, and to perform any act restricted by any right for any purpose reasonably related to the provision and operation of LuvFans.VIP (for all “user content”), non-exclusive, irrevocable, royalty-free, perpetual, sub-licensable, transferable, assignable right, allowing LuvFans.VIP to reproduce, distribute, publicly display, publish and create adaptations or derivative content as necessary. This means that the license granted will be continuous even when your user account is closed or your agreement with LuvFans.VIP ends, that we do not have to pay you for the license, and that in some cases we may we grant a sublicense of your content to someone else or assign or transfer the license to someone else. You also grant in agreement to the license to allow us (but not limited to) to add watermarks, stickers or logos to your content. LuvFans.VIP may sell or transfer any license you grant to us in these Terms and Conditions in the event of a sale of our company or its assets to a third party. We will never sell your Content to other platforms.

Violation of Terms and Conditions

LuvFans.VIP reserves the right, at our sole discretion, to block your IP address from accessing our website, temporarily suspend your access/subscription, permanently prohibit you from accessing our website, send you one or more formal warnings, terminate, suspend or delete your LuvFans.VIP account without prejudice to our other rights under these terms and conditions, if we reasonably suspect that you have failed to comply with these terms and conditions, provisions, in breach of, or if you have breached our terms and conditions in any way.

This is in addition to all other remedies LuvFans.VIP may have at law, in equity, whether for breach of contract or otherwise commence legal action against you. Where we may block, suspend or prohibit your access to LuvFans.VIP you agree to not take any action to circumvent such blocking, prohibition, suspension (including but not limited to using or creating a different account, using a different IP address or email account).

Limitation of Liability

LuvFans.VIP do not limit or exclude our liability where it would be unlawful or permitted by applicable law of England or Wales. This includes:

a). any liability resulting for death or personal injury resulting from our negligence;

b). any liability for fraud or fraudulent misrepresentation.

c). If you are a consumer, your statutory rights will not be limited or excluded by these Terms and Conditions, except by the extent permitted by applicable law.

d). If you are a consumer, user, business, advertiser or group you agree that LuvFans.VIP, our subsidiary companies, third parties, employees, representatives or agents will not be liable to you or any third party for any loss of profit, including (without limitation) business interruption, loss of business revenue, reliance or use of any content stored on LuvFans.VIP, reputation, loss of sales, loss of any data including content, cost of recreating data or cost of capital, loss of business opportunity or loss of anticipated income, credit, savings, goodwill, contracts, commercial opportunities or bonus to you arising from or in connection with your use of LuvFans.VIP, our features, programs.

e). You agree that LuvFans.VIP will not be held liable to you or any third party for any punitive, negligence, exemplary, incidental, indirect or special damages of any nature arising from breach of contract, breach of warranty, statutory duty, consequential or any other legal theory, whether in contract or tort, even if foreseeable or even if such party has been apprised of the likelihood of such damages occurring.

f). LuvFans.VIP does not guarantee that LuvFans.VIP, it’s content or website will be always available or accessible without interruption. We may update, enhance functionality, change, address any security issues, restrict, change our services to improve performance, withdraw or suspend the availability of any part or all of LuvFans.VIP for operational or business reasons. Our website may be down from time to time to carry out maintenance or for reasons out of our control (by our third parties or associates), we will try to give you reasonable notice where possible of any major changes, withdrawals or any suspensions, however this may not always be possible. We will always try to keep such periods of interruption down to a minimum where possible.

g). LuvFans.VIP will not be liable for any loss or damage caused by a virus, data, features, programs, ransomware, computer programs, technologically harmful material that may infect your equipment or devices, distributed denial-of-service attack, downloading of any content, any website linked to us or other proprietary material due to your use of LuvFans.VIP or any of its service.

h). By using our website you agree that LuvFans.VIP total liability to you for any and all claims arising out of or related to your agreement with LuvFans.VIP whether in contract or tort (including negligence), breach of statutory duty or otherwise shall be limited to the amount such user paid to LuvFans.VIP within the immediate preceding twelve month period.

I). LuvFans.VIP will not be liable to you in respect of any damages or losses arising out of any event or events beyond our reasonable control or in respect of any consequential loss, special or indirect damage.

j). You agree to not holding LuvFans.VIP liable to you, if corruption, loss of any data, any disruption to our database occurs or you experience any software issues, as a consequence of your use of our website or services.

k). You acknowledge and accept that we are a limited liability company and by using or visiting our website you agree that you will not bring any claim against our staff or employees in respect to any losses that you may suffer or have suffered in connection with the use of our website or our Terms and Conditions (this will not exclude or limit the liability of our limited liability entity itself, omissions and acts of our staff or employees).

l). You agree that LuvFans.VIP is not party to any transactions between creators and users and we do not have any responsibility or liability to you in relation to any such transactions in regards to creators content that is purchased, or any other users content;

m). You agree that LuvFans.VIP, our contractors, representatives, owners or employees (unless mandatory in law) are:

excluded from certain terms and conditions unless we expressly include a commitment or pledge of responsibility it cannot be implied by law;
are not liable to you if your content is downloaded, distributed, copied, reposted, used on another website not endorsed by LuvFans.VIP,if its copyright is infringed by any third party, users or member of the public;
not held liable for any damage or loss suffered by you that is not a foreseeable result of our failing to use reasonable care and/or skill, breaching Terms and Conditions or our policies.
not held liable for any foreseeable or unforeseeable damage or loss if at the time you agreed to our Terms and Conditions both parties knew it might occur;
not held liable for any disclosure or publication of your personal data shared by a user, third party or entity without your consent (also known as “doxing”)

n). You agree that LuvFans.VIP will not be held liable to you for any delays or failures by us in complying with any parts of our terms or policies (unless mandatory in law) arising from events outside our reasonable control. You will be informed as soon as possible if such an event occurs to let you know what steps we are taking to minimize the effect of the delay.

Our users on LuvFans.VIP will have an opportunity to socialize with their favorite creators, subscribe, tip, unlock their posts, follow, like their posts and/or share their posts message of people who they wish to be a fan of.

By using LuvFan.VIP’s services and website you warrant, agree and accept that LuvFan.VIP holds no liability whatsoever for any loss or damage that may arise from your use of our website and those of any associated third parties.

Subscriptions

"Subscription" means a fan's monthly subscription to a Creator’s account; LuvFans.VIP facilitates content creators subscriptions allowing you to follow any creator's profile and gain access to their content. You must sign up to LuvFans.VIP and create an account to follow a content creator. If you wish to subscribe to a creator you must click on subscribe and complete the payment process. You will then be subscribed for your first month and your subscription will auto-renew each month.

LuvFans.VIP facilitates transactions and interactions between creators and users by providing the LuvFans.VIP platform to take transactions and store content on your behalf. LuvFans.VIP are not party to the Creator and Fan Contract or any other contract between a fan and a creator. LuvFans.VIP are not responsible for any content, transactions or interactions between fans and creators.

You have authorized LuvFans.VIP to supply your payment details to a third party payment provider to transact payments on your behalf. In the event of recurring subscription payments, you give authorization to LuvFans.VIP to automatically renew your subscription fee payments at the price originally signed up for until you notify us that you wish to cancel your subscription/recurring payments. Creators price increases or decreases are only valid for new subscriptions and do not affect automatic re-subscriptions.

LuvFans.VIP reserves the right to suspend our service to you in the event you have provided incomplete, or inaccurate payment information or if your payment details are out of date. Asides from free subscriptions, you will benefit from the subscription services purchased as long as your account is active and your recurring payments are received by LuvFans.VIP.

In the event that you decide to cancel a subscription, you will still be granted access to the creators content until the end of the subscription period, no further payments will be taken for that particular subscription and you will not be able to view the content creators' chargeable subscription content once the monthly calendar subscription period is over.

LuvFans.VIP may use a third party payment processor to process service payments. Our name “LuvFans.VIP”, related names, service marks and logos; our other registered or unregistered trademarks are trademarks belonging to us, and all related names, designs, our websites logos, scripts, page headers, products, service names, slogans, headers, marks, custom graphics, domain names and any marks owned by LuvFans.VIP, affiliates or licensors must not be used in connection with any third party marks, products, services or otherwise that is not ours. Any use of LuvFans.VIP marks must adhere to our guidelines, inline with our terms and conditions only where permission is given, otherwise it may constitute an infringement of our rights.

All other third party marks, names, registered trademarks or unregistered trademarks, service marks, products or otherwise are the property of their respective owners unless stated otherwise in these terms and conditions.

Reference to LuvFans.VIP services, products marks, information, processes, unregistered or registered trademarks or otherwise does not imply or constitute our endorsement, recommendation, sponsorship or any other affiliation. We cannot grant any licence to exercise such rights of holders of any associated third parties.

Breaking our terms and conditions may result in your profile being removed and your account being closed down indefinitely. Any creator found by LuvFans.VIP to be abusing their profile, breaching our terms and conditions and/or policies will may have their membership terminated, suspended or investigated with no remuneration.

Governing Law

You agree and acknowledge by using our website and services that LuvFans.VIP terms and conditions, website, jurisdiction and all other matters are governed under the law of England and Wales, without regard to conflict of law provisions. You agree that it is solely your responsibility to adhere to mandatory rules set in your legal country of residence. You agree and acknowledge any court proceedings which may occur will be solely heard through the English courts. Any matters, cause of actions or claims must be filed within 12 months after the date of such claim or matter arose or it will be barred.

Complaints

If you have a complaint please send your name, address, telephone number, contact details, full description, url(s) of the page of your complaint any additional details (including whether you are depicted in any of the content, whether you agreed to the recording of the content and whether you agreed to the publication of the content, include any supporting evidence) to complaints@luvfans.vip.

a). We will acknowledge, review and respond to your complaint within 7 business days.

b). We will let you know if we require further information from you.

c). We will take appropriate action to investigate/review the complaint, this could include but not limited to removal of content that violates our terms, suspension, temporary loss of access, deletion of the users account, a ban or report to government bodies.

d). Please be aware that we are not under any obligation to inform you of the outcome of the complaint made against other users.

e). Luvfans.vip permits the reporting of content that may be illegal, infringes copyright or otherwise violates our terms and conditions

f). The appeals process for any decisions made in relation to a complaint or abuse takedowns can be sent to support@luvfans.vip with a written description for the basis of appeal. In the case where disputes over consent cannot be resolved internaly, such disputes are submitted to a neutral arbitration association. Once action has been taken or more information is needed from you, we contact you via email.

Changes to our Terms and Conditions

We may make changes to our Terms and Conditions and give you notice via email or through our website. Changes made to our Terms and Conditions will come into effect from the date published. You may end your agreement with us before changes to our Terms and Conditions are updated on LuvFans.VIP, once our revisions are in effect you will be bound to them if you continue to use LuvFans.VIP.

Self employment agreement

LFVP hereby confirms that we act as a collection agent for all creators on Luvfans.VIP. Funds received to our account would be income to creators with LFVP Limited only receiving a commission as agreed with each creator and as stated in these Terms and Conditions. You agree that all income generated will be done so in a self employed capacity making it your responsibility to report all income generated via Luvfans.VIP to local tax authorities where you reside and tax to be paid where applicable.
